Charged with intoxication assault?

Intoxication Assault is a third degree felony. In order to prove Intoxication Assault the State must show that serious bodily injury was caused by the driver of a vehicle and the driver's intoxication was a cause of the injuries. In Texas serious bodily injury is defined as an injury that creates a substantial risk of death or that causes serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.

The punishment range is anywhere from 2-10 years in prison and up to a $10,000 fine. A person can get community supervision for Intoxication Assault, but it may be difficult depending on the severity of the injuries. A person will have their driver's license suspended for 180 days to a year. If person does get probation you must serve a minimum of 30 days in jail as a condition of probation, and could get up to a maximum of 180 days in jail. The community service will range from 160-600 hours, and drug and alcohol treatment may be required.
